What is the ESA Minimum?

The Employment Standards Act sets the absolute floor — your employer must pay at least this, regardless of any contract. In Ontario it includes both notice pay and severance pay if you qualify.

What is Common Law Notice?

Courts can award far more than the ESA minimum. The "Bardal factors" — your age, seniority, length of service, and how hard it is to find a comparable job — all push the number up.

Should I Accept the First Offer?

Employers routinely offer only the statutory minimum. Most employees who negotiate receive significantly more. Knowing your range puts you in a much stronger position.
